By using our website you agree to the following terms and all of our other policies. Please read it carefully.

Terms for all Users

These Terms of use for all Users govern your use of stockjunkies and your agreement with us.
Interpretation:
1. We refer to our website as “stockjunkies” accessed via any web browser;
2. By referring to “we” “our”, “us” we mean Stock Junkies B.V., the operator of stockjunkies;
3. By “content” we mean any uploaded material to the stockjunkies website(whether a Creator or Junky), including any photo’s, logo’s, banners, video’s, livestream material, data, text, metadata, images, memes and other material whatsoever;
4. “Creator” means user who created a channel on our platform to create content for Junkies;
5. “Junky” or “Junkies” means a user who is subscribed to a Creator’s channel;
6. “Channel” is a place on the website where Creators place content;
7. Junky payment” means any and all payments made by a Junkie to a Creator;
8. “Standard Contract between Junkie and Creator” means the terms which govern each transaction between a Junkie and a Creator on stockjunkies, you can find this contract here.
9. “Terms and Conditions” or “your agreement with us” means the legally binding agreement with the following Terms and Conditions and Policies:

Stockjunkies is operated by Stock Junkies B.V. We are a company registered in the Netherlands, with company registration number 80104398 and we have our registered office address at Keizersgracht 174,
1016 DW in Amsterdam. Our VAT number is NL861555983B01.

We are allowed to make changes to the Terms and Conditions without telling you beforehand in the following cases:
1. We may change any part of the Terms and Conditions without notice in the following circumstances: to reflect changes in laws and regulatory requirements which apply to stockjunkies and the services, features and programs of stockjunkies where such changes require stockjunkies to change its Terms and Conditions in a manner which does not allow us to give reasonable notice to you; and
2. to address an unforeseen and imminent danger related to defending stockjunkies, Junkies or Creators from fraud, malware, spam, data breaches or other cybersecurity risks.

We may also make other changes to any part of the Terms and Conditions. In this case we will give you reasonable notice of these changes by email or through stockjunkies.

We are allowed to make changes or suspend or withdraw stockjunkies: We are allowed to update and change stockjunkies at any time for any reason, including any changes to our services to improve performance, enhance functionality or for security reasons. We will try to give you reasonable notice of major changes, but are not obliged to. We do not guarantee that stockjunkies or any of the content on stockjunkies will always be available or accessible without interruption. We are allowed to suspend or withdraw or restrict the availability of all or any part of stockjunkies for business or operational reasons. We will try to notice you beforehand of any suspension or withdrawal if it affects you, but we are not obliged to.
Registering with stockjunkies. To use stockjunkies you have to register and create an account on stockjunkies. You must provide a valid email address, a username and a password and validate the account through a Twitter of Google account. Your password should be unique(not the password you use on other websites) and you must comply with any of the technical requirements of the stockjunkies website for the composition of passwords. To register as a user:
1. You must be at least 18 years old and you will be required to confirm this;
2. If you are between 14 and 18 years old, you need consent from you parents or legal guardian to create and use an account at stockjunkies;
3. Your countries legislation must allow you to use an account at stockjunkies;

If you do need meet the requirements, you are not allowed to access or use stockjunkies.

When you register and use stockjunkies, you make the following commitments to us:
1. If you had a stockjunkies account before, you confirm that your old account was not terminated or suspended by us due to a violation of our Terms or Policies.
2. The information you give us must be truthful, accurate and complete.
3. If anything changes about your information you have submitted with us, you must update that information promptly.
4. You give consent to receiving communications from stockjunkies electronically and the processing of your personal data. You can read the Privacy Policy to see what which data is stored and what we do with this data.
5. You will keep your account and login details confidential and secure. You are not allowed to share your stockjunkies account with anybody. You will contact support@stockjunkies.com promptly if you are under the assumption that someone has been using your account and possesses your login details. You also agree to log out of your account after each session you have used the stockjunkies site.
6. You are responsible for all activity on your stockjunkies account, even if someone else uses your account.
7. You will comply in full with the Terms of Use for all users, acceptable use Policy and all other parts of the Terms and Conditions which apply to your use and account at stockjunkies.
Stockjunkies has the following rights and is allowed to suspend or terminate your account without restitution:
1. We can but are not obligated to moderate or review your content to verify compliance with our Terms and Conditions or any of the Policies or applicable legislation.
2. If any of the content you post does not comply with our Terms and Conditions or any of our other policies, we are allowed to suspend access, delete your content or terminate your account. If we suspend access or terminate your account, you may request a review of our decision by contacting us at support@stockjunkies.com. We are allowed to take any action we deem appropriate.
3. In case we decide to suspend access or terminate your account, we will notify you via email or electronic message to your stockjunkies account, but we are not obligated to give you prior notice.
4. We reserve the right to terminate your agreement with us and your access to stockjunkies for any reason by giving you 30 days’ notice via email. We can also suspend access or terminate your agreement with us immediately and without prior notice:
  1. if we think that you have or may have seriously or repeatedly breached any part of the Terms of Service (including in particular our Acceptable Use Policy), or if you attempt or threaten to breach any part of the Terms of Service in a way which has or could have serious consequences for us or another User; or
  2. if you take any action that in our opinion has caused or is reasonably likely to cause us to suffer a loss or that otherwise harms the reputation of stockjunkies.
5. In case of termination of your account, we may deal with your content in the way we deem appropriate in accordance with our policies(including deleting it). You will be no longer entitled to access any of your content.
6. We are allowed to investigate any suspected or alleged misuse, misconduct, abuse of stockjunkies and cooperate with law enforcement agencies in such investigation.
7. We are allowed to disclose any information in our possession to law enforcement agencies in connection with any law enforcement investigation of any suspected or alleged illegal activity, or in response to a court order.
8. We are allowed to change the third party payment providers we use and will notify you within reasonable time if we do so.
9. Other than Content(Content owned or created by creators), all right in and to stockjunkies, source code, content created by stockjunkies(and not by a creator), are owned by us and/ or our licensors. Such material is protected by copyright and trademark, trade secret and other IP laws.
10. We are the exclusive owners of any and all anonymized data regarding your use of stockjunkies. This anonymized data can be used by us for any purpose, including any commercial purposes, development purposes and research purposes.
We are not responsible for the following:
1. We do not authorize or approve content on stockjunkies.
2. Views expressed by creators or junkies on stockjunkies, do not necessarily represent the view of stockjunkies.
3. We do not grant any rights in relation to content or the viewing of content. This right may be granted to you by creators.
4. Individuals can recognize your identity from content. We will not responsible if you are identified from your content.
5. All content is created and provided by users and not by stockjunkies. We are not responsible for reviewing, moderation, adjusting content. We are not obligated to monitor content or detect any breaches of our Terms and Conditions or other Policies.
6. We do not make any promises or guarantees of any kind that Creators will make a particular sum of money(or any money at all) from their use of stockjunkies.
7. We do not promise nor guarantee that stockjunkies is compatible with all devise and operation systems. You are responsible for configuring your information technology, device and software to access stockjunkies. We are not responsible for virus protection software.
8. You are responsible for your own internet connection or any other errors in your connection, device or other equipment that you use in relation to your access and use of stockjunkies.
9. We cannot promise that the stockjunkies website is free from bugs and viruses and we cannot make promises and have no control over the content that is supplied by Creators.
10. We are not responsible or accountable for any lost, stolen or compromised user accounts; passwords, email account, unauthorized payments, unauthorized activities, withdrawal of funds.
11. You acknowledge that after posting your content on the stockjunkies website, we cannot control and will not be responsible to you for any use which other users or other third parties do with you content. You are allowed to delete your account at any time, but you acknowledge that deleting your account will not prevent the circulation of your content which might have been recorded by users or other third parties in breach with our Terms and Conditions or other policies prior to the deletion of your account.
Intellectual property rights(IP rights), ownership and licenses:
1. By posting content(including livestreaming) on the stockjunkies website you confirm that you have the intellectual property rights of that content or have obtained the necessary rights to that content or own licenses for that content. This includes any rights required to engage in the acts covered by sub-section 10(b) below in any territory in which Stockjunkies is accessible and, in particular, in the United States of America, the United Kingdom and the European Union.
2. You agree to grant us all licenses needed under all your content to perform any act restricted by any intellectual property right(including copyright) in such content, for any purpose reasonably(deemed by us) related to the provision and operation of
3. The license which you grant to us under sub-section 10(b) above is perpetual, non-exclusive, worldwide, royalty-free, sublicensable, assignable and transferable by us. This means that the license will continue even after your agreement with us ends and you stop using stockjunkies, that we do not have to pay you for the license, and that we can grant a sub-license of your Content to someone else or assign or transfer the license to someone else. This license will allow us, for example, to add stickers, text, and watermarks to your Content, to make your Content available to other Users of stockjunkies, as well as to use your Content for other normal operations of stockjunkies. We will never sell your Content to other platforms, though we may sell or transfer any license you grant to us in the Terms and Conditions in the event of a sale of our company or its assets to a third party.
4. Whilst we do not own your Content, you grant us the limited right to submit notifications of infringement (including of copyright or trademark) on your behalf to any third-party website or service that hosts or is otherwise dealing in infringing copies of your Content without your permission. Although we are not under any obligation to do so, we may at any time submit or withdraw any such notification to any third-party website or service where we consider it appropriate to do so. However, we do not and are under no obligation to police infringements of your Content. You agree that if we request, you will provide us with all consents and other information which we reasonably need to submit notifications of infringement on your behalf. Please see our Complaints Policy for how to make a complaint about infringement of intellectual property rights.
5. You waive any moral rights which you may have under any applicable law to object to derogatory treatment of any Content posted by you on stockjunkies. This waiver does not affect in any way your ownership of any intellectual property rights in your Content or the rights which you have to prevent your Content from being copied without your permission. The waiver is intended to allow us when dealing with your Content (as permitted by the license which you give us in section 10(b) above) to add watermarks, stickers or text to your Content.
You agree that:
1. You are allowed to link to the stockjunkies homepage but only in a way that does not damage our reputation. You are not allowed to make it seem or suggest that you have an association or endorsement from stockjunkies.
2. Whenever you are promoting your channel, you must comply with our Terms and Conditions, but also comply with the Terms and Cconditions of any other website that you use when promoting.
3. You are not allowed to impersonate stockjunkies.
If you to delete your stockjunkies account:
1. In case you are Junky, we will delete your account within a reasonable time following your request.
2. If you are a creator, your account will remain open until the last of your junkies paid subscription ends. If the final subscription is over, we will delete your account.
In case of damages:
1. If you are a consumer User you agree that: stockjunkies and subsidiary companies, employees, owners, agents and representatives will not be liable to you for any loss of business, losing trades, loss of revenue, business interruption arising from or in connection to your use of stockjunkies.
2. If you are a consumer User and resident of the United States of America, our total liability to you for claims arising out of or related to your agreement with stockjunkies is always limited to EUR 250 per claim.
3. If you are a Business User you agree that:
  1. Stockjunkies and our subsidiary companies, employees, owners, representatives and agents:
    1. Do not give any rights, warranties, promises of commitment from stockjunkies from creating an account at stockjunkies.
    2. Are not in any way responsible to you for any kind of loss or damage suffered by you that is not a foreseeable result of us breaching the Terms and Conditions or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if both parties knew it might happen at the time you agreed to the Terms and Conditions.
    3. Will not be liable to you for any loss or damages (including trading losses), breach of statutory duty, or otherwise, even if foreseeable, arising out of or in connection with
      1. Your inability to use stockjunkies or any of its services or features; or
      2. Your use of or reliance on any content stored on stockjunkies;
    4. We will also not be liable to you for any:
      1. Loss of profits;
      2. Loss of sales, business, or revenue;
      3. Losing trades
      4. Business interruption;
      5. Loss of business opportunity, goodwill or reputation;
      6. Loss of data or information;
      7. Indirect losses or damages;
    5. Won’t be liable to you if your content is copied, distributed, reposted outside of stockjunkies or is copied by another user or third party;
    6. Won’t be liable to you for disclosure of your identity or publication of your personal information by other users or third parties without your consent;
    7. Won’t be liable to you for any failure or delay caused by third parties, including by programs of other parties such as worms, viruses, malware or other maleficent programs.
    8. Our liability to you for any claim arising out of or related to your agreement with stockjunkies, or use of stockjunkies, shall always be limited to either:
      1. 100% of the total fees paid to you by stockjunkies;
      2. EUR 5,000.
    9. Won’t be liable to you for any of your trading. You as a business owner decide on your own which stocks you pursue and trade.
You agree that:
1. If any aspect of your agreement with stockjunkies is unenforceable, the rest of the agreement will remain in effect.
2. In case of an unenforceable aspect in the stockjunkies agreement with you, it will not be a waiver.
3. Stockjunkies reserves all rights not expressly granted to you.
4. We do not grant you implied licenses or other rights in relation to any part of stockjunkies, save as expressly set out in the Terms and Conditions.
5. Your agreement with stockjunkies does not give rights to any third parties.
6. You are not allowed to transfer your rights or obligations under your agreement with us without our prior written consent.
7. Our rights and obligations under your agreement with stockjunkies can be assigned or transferred by us to others. This could occur if our ownership changes in case of a merger, acquisition or sale of assets or by law. We may also choose to delegate performance of any of our rights or obligations under your agreement with us to any third party, but we will remain responsible for the performance of such rights or obligations.
The law which applies to your agreement with us and where disputes and claims concerning stockjunkies can be brought:
1. For consumers(junkies)
  1. If you are a consumer your agreement with us is governed by Dutch law and Dutch law will apply to any claim you have against us or we have against you that arises out of or in connection with your agreement with stockjunkies(including non-contractual disputes or claims).
  2. If you are a consumer any claim arising out of or in connection with your agreement with stockjunkies(whether by you against us, or us against you, including non-contractual disputes or claims) must be brought in the courts of the Netherlands in Amsterdam.
2. For Business users
  1. If you are a business user your agreement with us is governed by Dutch law and Dutch law will apply to any claim you have against us or we have against you that arises out of or in connection with your agreement with stockjunkies(including non-contractual disputes or claims) without regard to conflict of law provisions.
  2. If you are a business user you and we agree that the courts of Netherlands shall have exclusive jurisdiction to resolve any dispute or claim(including non-contractual disputes or claims), whether by you against us, or us against you.
3. Limitation on period for bringing claims: Except where prohibited by binding applicable law, any claim or cause of action which you have concerning stockjunkies(including any arising out of or related to your agreement with us) must be filed within one year after the date on which such claim or cause of action occurred or on the date which you learned the facts(whichever is the earlier), or be forever barred and waive any rights to such a claim.
The following Terms and Policies govern your agreement with stockjunkies will apply to you and form part of your agreement with us:
1. Terms of Use for Junkies: which contain additional terms which apply to you if you use stockjunkies as a Junky;
2. Terms of Use for Creators: which contain additional terms which apply to you if you use stockjunkies as a Creator;
3. Privacy Policy: which applies to all users of stockjunkies and tells you how we use your personal data we collect about you and your use of stockjunkies;
4. Acceptable Use Policy: which applies to all Users and tells you what you can and can’t do on stockjunkies;
5. Complaints Policy: which sets out the procedure for filing complaints about any aspect regarding stockjunkies and how we will deal with your complaint;
6. Business regulation Terms: which contain additional terms which apply to creators who are established or resident in the European Union or United Kingdom.

In case of conflicting terms between any of our policies the Terms for all Users shall prevail and apply to the extent of the conflict.

Terms of use for Junkies

By using our website as a junky you agree to these terms

The following terms of use for Junkies are additional terms which apply if you use stockjunkies as a Junky(also referred to as “you”, and “your” in these Terms of Use for Junkies”. These Terms of Use for Junkies form part of your agreement with stockjunkies.
Defined terms have the same meanings as given to them in the Terms and Conditions for all users. In addition:
1. “Subscription” means a Junky’s monthly subscription to a Creator’s account;
2. “VAT” means Dutch value added tax and any other tax imposed in addition to or in substitution for it at the rate from time to time imposed and any equivalent or similar governmental state, federal, provincial, or municipal indirect tax, charge, duty, impost or levy in any other jurisdiction,
3. Tax” shall include all forms of tax and statutory, governmental, state, federal, provincial, local government or municipal charges, duties, imposts, contributions, levies, withholdings or liabilities wherever chargeable and whether of the Netherlands or any other jurisdiction.
You agree to the following terms will also apply to your use of stockjunkies:
1. Our Terms of Use for all Users;
2. Our Privacy Policy;
3. Our Acceptable User Policy;
4. Our Complaints Policy;
5. The standard contract between Junky and Creator;
The following terms may also apply to your use of stockjunkies:
1. If you are a creator, the Terms of use for Creator’s;
2. If you are a creator and established or resident in the European Union or United Kingdom, the Business Regulation Terms will also apply to you.
You warrant that:
1. You are at least 18 years old;
2. If you are between 14 and 18 years old, you have consent from your parents or legal guardian to create an account at stockjunkies;
3. You are not barred from accessing stockjunkies under any laws that apply to you.
You agree that if you choose to follow a Business User that:
1. The Business owner is merely showing how he trades and does not give financial advice;
2. Stockjunkies always advices you to seek professional advice(not our business Users) before taking any position on the stock market;
3. If you decide to trade on the stock market you acknowledge that you probably will lose money, you trade at your own risk and you agree that stockjunkies nor its Business Users are liable for any trading losses you or others have.
In addition to Terms set out in our other Policies, the following Terms apply to the content posted, displayed, uploaded or published by you as a Junky on stockjunkies:
1. You warrant that for each item of content which you post, display, upload or publish on stockjunkies:
  1. The Content complies fully with all our Terms and Policies;
  2. You own your Content or have a valid license to your Content; and
  3. If your Content includes use of any third party material, you have secured all rights, licenses, written consents for the use of that Content and you agree to waive any claim against stockjunkies in the case you have not secured it.
2. You agree that you will be liable to us and indemnify us if any of the warranties at section 6(a) is untrue. You will be responsible for any loss or damage we suffer as a result of any warranty being untrue.
The Creators on our platform post content about trading in order to make you understand how they trade. You acknowledge that the fact that creators do not give financial advice of any kind. You also agree that:
1. any trade you make based on information you received from creators on stockjunkies is your own decision and at your own risk. You also agree that the received information is not financial advice; and
2. that stockjunkies is not liable for the Content Creators post on stockjunkies.
3. stockjunkies does not guarantee that you will learn how to be profitable or that you will make money on or by stockjunkies.
Regarding transactions you acknowledge the following:
1. All transactions and interactions facilitated by stockjunkies are contracts between Junkies and Creators on the Terms of the Standard Contract between Junkie and Creator. Stockjunkies is not a party to the Standard Contract between Junkie and Creator or any other contract that may exist between Junkie and Creator. Stockjunkies is not responsible for any transactions or interactions between Junkies and Creators.
2. Creators are responsible for pricing(within our parameters) on stockjunkies. All prices appear in EURO’s.
3. Junky Payments are exclusive of VAT, which shall be added at the current rate as applicable to Junkie Payments.
4. To view cCreator’s Content the Junkie must first add a payment card to your account and must be subscribed to the relevant creator’s channel.
5. You authorize stockjunkies to supply your payment card details to a third party payment provider for the purpose of processing your Junkie Payment. All Payments will be processed in EURO’s. It is possible that your card provider will charge you with exchange rates. We are not responsible for those exchange rates and any extra costs regarding exchange charges or currency value changes.
6. The payment provider will take monthly payments from your payment card for Junky Payments which are subscriptions.
7. If you cancel a subscription you will be able to access the content until the end of that month. If you choose not the renewal your subscription at the end of that month, you will not be able to access the Content of the relevant Creator anymore. Your subscription will renewal automatically if you do not cancel.
8. You agree that you will not make unjustified requests for a refund from any Creator you follow.
We are allowed to suspend your user account in accordance with our rights under the Terms and Conditions. In case we suspend your account we will also suspend payments for the period of time your account is suspended.

Terms of use for Creators

By using our website as a creator you agree to these terms.

The following Terms of use for Junkies are additional terms which apply if you use stockjunkies as a Creator(also referred to as “you”, and “your” in these Terms of Use for Junkies”). These Terms of Use for Junkies form part of your agreement with stockjunkies.
Defined terms have the same meanings as given to them in the Terms and Conditions for all users. In addition:
1. “Person with Majority Control” means any individual who meets one or both of the following conditions in relation to corporate entity:
  1. The individual holds, directly or indirectly more than 50 percent of the shares in the corporate entity;
  2. The individual holds, directly or indirectly, more than 50 percent of the voting rights in the corporate entity;
  3. The individual holds, directly or indirectly, more than 50 percent of the profit rights in the corporate entity;
2. “VAT” means Dutch value added tax and any other tax imposed in addition to or in substitution for it at the rate from time to time imposed and any equivalent or similar governmental state, federal, provincial, or municipal indirect tax, charge, duty, impost or levy in any other jurisdiction,
3. Tax” shall include all forms of tax and statutory, governmental, state, federal, provincial, local government or municipal charges, duties, imposts, contributions, levies, withholdings or liabilities wherever chargeable and whether of the Netherlands or any other jurisdiction.
You agree to the following terms will also apply to your use of stockjunkies:
1. Our Terms of Use for all Users;
2. Our Privacy Policy;
3. Our Acceptable User Policy;
4. Our Complaints Policy;
5. The standard contract between Junky and Creator;
The following terms may also apply to your use of stockjunkies:
1. If you also a Junky, the Terms of use for Junkies;
2. If you are a Creator and established or resident in the European Union or United Kingdom, the Business Regulation Terms will also apply to you.
You warrant that:
1. You are at least 18 years old;
2. If you are between 16 and 18 years old, you have consent from your parents or legal guardian to create an account at stockjunkies;
3. You are not barred from accessing stockjunkies under any laws that apply to you.
We charge a fee of twenty percent (20%) of all subscriber Payments made to you (exclusive of any VAT element of the Junky Payment). The remaining eighty percent (80%) is payable to you. Our fee is withheld from the subscribers payment to you.
You agree that Junkies can choose to pay for a yearly subscription and that if they do so, they receive a discount. You agree that this discount is not loss of revenue.
You can create a Creators account by sending a request email to support@stockjunkies.com. We will need the following materials from you:
1. A logo, a banner and profile picture;
2. Your content videos;
3. Your bank account number or payment card;
4. Your ID;
5. Your subscription price between the ratio of thirty and a thousand EURO’s;
6. You may also need to submit additional information depending on your country of residency or establishment.
7. We are allowed to reject your application to setup a creators account for any reason.
Agencies will be rejected as Creators.
In case you want to apply for a Creator account as a corporate entity you must provide proof that you are a majority owner of that entity.
The Creator ensures that he delivers enough Content and that he livestreams enough times a week as may reasonable can be expected by stockjunkies based on the price he has set himself.
The Creator agrees that stockjunkies is not responsible for any content, watchlists or stocks. Your channel is your responsibility and stockjunkies does not guarantee any subscribers, revenue, or trading profits.
Regarding transactions you acknowledge the following:
1. All transactions and interactions facilitated by stockjunkies are Contracts between Junkies and Creators on the Terms of the Standard Contract between Junkie and Creator. Stockjunkies is not a party to the Standard Contract between Junkie and Creator or any other contract that may exist between Junky and Creator. Stockjunkies is not responsible for any transactions or interactions between Jjunkies and Creators.
2. Junkie Payments are exclusive of VAT, which shall be added at the current rate as applicable to Junky Payments.
3. When a Junky has made the required payment for the subscription to your content you must allow the Junky interaction function on your account and allow them to view content. You agree to indemnify stockjunkies for any breach by you of this obligation. You will be responsible for any loss or damage we suffer as a result of you failing to comply with this obligation.
In addition the following terms also apply to you as a Creator:
1. You agree that your content is not confidential and you authorize your Junkies to access and view your content for their personal use.
2. You warrant that for each item of content you post, upload or livestream:
  1. The content complies in full with our Terms and Conditions and our other Policies;
  2. You hold all rights necessary to license and deal in your Content;
  3. You either own your content or have a valid license to offer and supply your Content to your Junkies;
    1. The content is:
      1. Of satisfactory quality;
      2. Not financial advice;
      3. As described by you.
3. You agree that you will be liable to us and indemnify us if any of the warranties in section 11 (b) of this Policy is false or untrue.
4. You agree that stockjunkies is not responsible for Content and we do not endorse any Content.
5. You agree to waive any claims against stockjunkies arising from Co-Authored Content. You agree that if you post Co-Authored Content, you will be solely responsible and any claim will be made against the Creator who posted the Content and not against stockjunkies.
Regarding payouts to Creators:
1. All Junky Payments will be received by a third party payment provider approved by stockjunkies.
2. Our payment provider will collect the Junky Payment and:
  1. Withhold Our fee for the usage of stockjunkies; and
  2. Pay the Creator earnings to the bank account the Creator has provided us.
3. At the end of each month our Payment provider will pay out the amount the Creator has earned that month. If a new Junky subscribed, they payout of that subscription will follow in the next month.
4. If a Junky successfully gets a refund or chargeback from their credit card provider regarding a Junky Payment, we may decide to deduct an equal amount from the relevant Creators earnings.
In the following circumstances we may withhold creators Earnings:
1. We are allowed to withhold all or any part of the Creators Earnings which have not been paid out yet:
  1. If we think that the Creator has or may have seriously or repeatedly breached any part of the Terms and Conditions or our other Policies;
  2. If a creator attempts or threatens to breach any part of the Terms and Conditions or our other policies in a way which we think has or could have consequences for stockjunkies; or
  3. If we suspect unlawful activities regarding a Creators account or Junky Payments made to that account.
2. We are allowed to withhold Earnings for as long as is necessary to investigate the suspected activity. If stockjunkies decides that your breach of 13 (a) is serious enough, we may decide that the relevant Creator forfeited their Earnings.
3. By breaching 13 (a) you waive any claim you have against stockjunkies.
4. If we have decided to forfeit a Creators Earnings, we will try to return as many Junky Payments as possible regarding the forfeited Earnings.
Regarding Tax:
1. Creators are solely responsible for their own Taxes, Tax reporting and Tax affairs. We recommend that Creators seek professional advice concerning their Taxes in order to be fully compliant with any applicable Tax laws.
2. By creating a stockjunkies account you warrant that you will report every payment made to you from your use of stockjunkies to the relevant Tax authority as required by law.
3. In the case a Tax authority starts an inquiry regarding Tax non-compliance against you as a Creator on stockjunkies you agree that you will:
  1. Notify us of the inquiry and the contents of the inquiry within 10 days be sending an email to legal@stockjunkies.com; and
  2. Notify us by email to legal@stockjunkies.com concerning the steps you going to take regarding the Tax non-compliance.
4. Stockjunkies is allowed to close your account if we are notified or become aware of Tax non-compliance by a Creator.

Acceptable use Policy

By using our website you agree to this policy. This Policy applies to all Users of stockjunkies.

In this Policy defined terms have the same meanings as in our Terms for All Users Policy.
You shall not use stockjunkies except for your own personal use. You will not sell, rent, transfer or share your account or any Content obtained from your use of stockjunkies to or with anyone else.
You shall use stockjunkies in a manner and purpose that is lawful.
Do not use stockjunkies in any way which may exploit or harm any individual.
You are not allowed to upload, post or publish any content on stockjunkies that is, shows, promotes, advertises or refers to:
1. Illegal;
2. Fraudulent;
3. Racist;
4. Defamatory;
5. Hateful;
6. Discriminatory;
7. Incrimination;
8. False information;
9. Violence;
10. Threatening;
11. Harassing;
12. Hate speech;
13. Porn or nudes;
14. Any form of porn;
15. Encourages or promotes violence;
16. Illegal activity; or
17. Financial advice;
18. Firearms, weapons or anything related;
19. Drugs;
20. Self harm or suicide;
21. Necrophilia;
22. Bestiality;
23. Escort services, sex trafficking, or prostitution;
24. Deepfakes;
25. Forced;
26. Personal data from others;
You will not promote third parties on stockjunkies in any way to your Junkies.
You will not promote your second or any other business on stockjunkies in any way to your Junkies.
You will not spread, publish, share or post personal data from other Users.
You will not use stockjunkies to bully, stalk, abuse, harass, threaten or intimidate anyone.
You will not use stockjunkies to mislead or deceive other Users.
You will not impersonate stockjunkies or falsely state that stockjunkies endorses or sponsors you in any way.
You will not infringe or violate someone else’s rights regarding intellectual property rights, trademarks, personality rights, unfair competition, privacy in any way.
You will not provide false account, registration or bank account numbers to stockjunkies.
You will not spam your Junkies.
You will not transmit, stream, or otherwise send any pre-recorded video material during a live stream or otherwise fake a live trading session.
You will not reproduce, print or attempt to download stockjunkies.
You will not upload, place or introduce stockjunkies to any viruses, trojans, worms, logic bombs or other forms of harmful software or programs.
Do not decompile, disassemble, reverse engineer, or otherwise attempt to discover the stockjunkies source code.
You will not use any automated or semi-automated programs during your use of stockjunkies.
You will not gather any information about other Users from stockjunkies.
You will not use stockjunkies name, logo, designs, any of our content or any other related or similar names.

Breaches of this Policy can lead to the suspension, termination of your account. In addition it can lead to forfeiting your Earnings or Payments.

Complaints Policy

This policy sets out our complaints Policy. This Policy applies to all Users of stockjunkies and forms part of your agreement with us.
Who we are and how to contact us: Stockjunkies is operated by Stock Junkies B.V. We are a company registered in the Netherlands, with company registration number 80104398 and we have our registered office address at Keizersgracht 174, 1016 DW in Amsterdam. Our VAT number is NL861555983B01.
In this Policy defined terms have the same meanings as in our Terms for All Users Policy.
If you have a complaint you can send it to legal@stockjunkies.com including your name, address, contact details and a description of your complaint.
After receiving your complaint we will:
1. Take any steps we deem appropriate to investigate your complaint within reasonable time for the nature of your complaint;
2. We will contact you incase we need any additional information to complete our investigation;
3. We will in good faith take appropriate actions to deal with the complaint.

Stockjunkies is not obligated to inform you of the outcome of your complaint.

In case you are a User you warrant that you will not file any unjustified or abusive complaints. Any complaints made in bad faith can lead to the suspension or deletion of your account.

Business Regulation terms

Business regulation terms form part of the Terms and Conditions. This Policy applies to Creators who are established or resident in the European Union or United Kingdom in order to comply with EU Regulation 2019/1150.
In this Policy defined terms have the same meanings as in our Terms for All Users Policy.
Stockjunkies can choose to promote you through our Instagram, Twitter, TikTok, LinkedIn, Facebook or other social media accounts.
Stockjunkies does not favor Creators or maintains a ranking system. Users can rate their experience with Creators in order to inform other Users.
If you have a complaint about this Policy, the contents of it or non-compliance from stockjunkies in conflict with this Policy, you can send a complaint to legal@stockjunkies.com.
After receiving your complaint we will:
1. Take any steps we deem appropriate to investigate your complaint within reasonable time for the nature of your complaint;
2. We will contact you incase we need any additional information to complete our investigation;
We will in good faith take appropriate actions to deal with the complaint and inform you about our decision.
